Customer Shipping Agreement

These are the terms of the Customer Shipping Agreement (version v2026-10) you sign for each order. The Agreement you sign for your order, together with its Order Summary, controls over this page.

This Customer Shipping Agreement (the “Agreement”) is between DBW Transport LLC d/b/a ShiftHaul (“ShiftHaul,” “we,” “us”) and the customer named in the signed Agreement (“Customer,” “you”). ShiftHaul is a licensed property broker (MC 1786043). ShiftHaul is a broker, not a motor carrier. We arrange transportation of your vehicle(s) with independent, licensed motor carriers.

1. Broker services

1.1 ShiftHaul arranges transport of your vehicle(s) by contracting with an independent licensed motor carrier (the “Carrier”). ShiftHaul does not transport vehicles and never takes physical possession of your vehicle(s).

1.2 ShiftHaul’s brokerage service is considered performed when a Carrier is assigned to your order and you are notified by email.

1.3 Carrier verification. Before assignment, ShiftHaul verifies the Carrier’s active FMCSA operating authority and insurance, and may use additional checks through its FreightSeal verification process (such as confirming the Carrier’s registered phone, obtaining the certificate of insurance from the insurance agent, and pickup confirmation). Carriers must carry at least $750,000 auto liability and $100,000 cargo insurance unless disclosed otherwise in writing. ShiftHaul does not insure your vehicle and does not guarantee any Carrier’s insurance coverage.

1.4 The Carrier assigned to your order is an intended third-party beneficiary of the sections on vehicle preparation, presence at pickup and delivery, inspection, and payment.

2. Your order

2.1 You confirm that the information in the Order Summary is accurate and complete, including vehicle year, make, model, size, modifications, and whether each vehicle runs, drives and steers (operable or inoperable).

2.2 You confirm that you are the legal owner of the vehicle(s) or are authorized by the owner to arrange this shipment.

2.3 If the information is inaccurate (for example, an inoperable, modified, oversized, or non-running vehicle, or different addresses), the price may change. You may accept the new price or cancel under Section 4.

3. Price and payment

3.1 Nothing is charged at booking ($0 due now). Payment is due only after a Carrier is assigned to your order.

3.2 Card. When a Carrier is assigned, ShiftHaul charges a $150 deposit (part of your Total Price) to the card on file. The remaining balance is charged to the same card when the Carrier arrives for pickup. Nothing is paid to the driver.

3.3 Pay on Delivery. The Total Price is 3% lower than the Card price. When a Carrier is assigned, ShiftHaul charges a $150 deposit to the card on file; the remaining balance is paid to the driver at delivery by cash, Zelle, Venmo, or cashier’s check.

3.4 By signing, you authorize ShiftHaul to charge the card on file the amounts described above — the $150 deposit when a Carrier is assigned, and, for Card orders, the remaining balance when the Carrier arrives for pickup. ShiftHaul may place a small temporary authorization to verify the card.

3.5 Add-ons. Fixed Pickup Day (+$200 per order) is available only when booked at least 5 days before the pickup date; the Carrier picks up on that day (time window not guaranteed). If the vehicle is not picked up on that day, the Fixed Pickup Day fee is refunded. Priority Dispatch (+$350 per order) places your order at the top of our dispatch queue with increased Carrier pay; it does not guarantee a specific pickup date. Enclosed transport and inoperable vehicles are already included in the Total Price.

3.6 If the Pay on Delivery balance is not paid at delivery, the Carrier may hold the vehicle until payment is made, and any storage or redelivery charges are your responsibility.

3.7 Price Lock. Once you sign this Agreement, your Total Price is locked. If the Carrier’s rate for your order increases before pickup, ShiftHaul will cover the difference at its own expense, up to $200 per vehicle. If a larger increase is needed, ShiftHaul will ask for your written approval before any additional charge; if you do not approve, you may cancel and your deposit is refunded in full. Price Lock does not apply if (a) information you provided about the vehicle or order (year, make, model, modifications, operability, size, trailer type, addresses or dates) is inaccurate or incomplete, (b) you change the order after signing, or (c) the vehicle is listed with or shipped by another company.

3.8 Late payments. Amounts due and unpaid, including after a payment reversal for services performed, accrue interest at 1.5% per month or the maximum rate allowed by law, whichever is lower, and you are responsible for reasonable collection costs, including attorneys’ fees.

4. Changes, cancellation and refunds

4.1 Before a Carrier is assigned: you may cancel at no charge.

4.2 After a Carrier is assigned but before pickup: ShiftHaul keeps the $150 deposit per order; the deposit is part of your Total Price and is non-refundable once a Carrier is assigned. For Card orders, the remaining balance has not yet been charged and will not be charged.

4.3 After pickup: the order cannot be canceled and the full Total Price is due.

4.4 Full refund: if ShiftHaul cannot assign a Carrier, or the assigned Carrier fails to pick up the vehicle and you choose to cancel instead of waiting for a replacement Carrier, all amounts paid to ShiftHaul are refunded.

4.5 Changes may change the price. Send all changes and cancellations in writing to [email protected].

4.6 If ShiftHaul has not assigned a Carrier within 14 days after the end of your pickup window, either you or ShiftHaul may cancel the order, and any deposit paid is refunded in full.

4.7 Events beyond control and cancellation by ShiftHaul. ShiftHaul is not responsible for delays or for cancellation caused by events beyond its reasonable control, including weather, road or traffic conditions, accidents, strikes, or acts of government. ShiftHaul may also decline or cancel any order before pickup; in that case any deposit paid is refunded in full and ShiftHaul has no further liability for that order.

5. Pickup and delivery

5.1 Pickup and delivery dates are estimates, not guarantees (except the Fixed Pickup Day in Section 3.5). Weather, traffic, road conditions, and mechanical issues can cause delays.

5.2 You or an adult (18+) you designate must be present at pickup and delivery, with the vehicle ready at the agreed time. If the vehicle is not available or no one is present, you are responsible for any dry-run, towing, storage or redelivery charges billed by the Carrier.

5.3 The Carrier will pick up and deliver as close to the addresses as it can legally and safely reach. A nearby safe meeting location may be used.

6. Vehicle preparation

  • Provide a working key for each vehicle.
  • Remove or secure loose parts, low spoilers, and exterior racks.
  • Remove or deactivate toll transponders; all tolls charged during transport are your responsibility.
  • Keep fuel at 1/4 tank or less, and disable any alarm.
  • Personal items up to 100 lbs are allowed in the trunk or below the window line. More weight is allowed only if ShiftHaul confirms it in writing with the Carrier, and it may cost extra. Personal items are always at your own risk and are not covered by ShiftHaul or the Carrier’s cargo insurance.
  • Do not leave weapons, ammunition, explosives, flammable or hazardous materials, drugs or medication, alcohol, cash, jewelry, legal or financial documents, pets, plants, perishables, or any illegal items in the vehicle.

7. Inspection, bill of lading and damage claims

7.1 At pickup, you and the driver inspect the vehicle and record its condition on the Bill of Lading. Take photos or video.

7.2 At delivery, inspect the vehicle before signing and write any new damage on the Bill of Lading. Signing a clean Bill of Lading is strong evidence that the vehicle was delivered without new damage.

7.3 Please notify ShiftHaul and the Carrier in writing within 7 days of delivery. Damage claims are made against the Carrier and its cargo insurance and are governed by federal law (the Carmack Amendment, 49 U.S.C. § 14706), including its time limits. ShiftHaul will provide the Carrier’s name, MC number, and insurance information and help you file the claim.

8. Limitation of liability

8.1 The Carrier, not ShiftHaul, is responsible for loss of or damage to your vehicle during transport. ShiftHaul is not liable for delays, personal items left in the vehicle, or events beyond its control.

8.2 To the extent allowed by law, ShiftHaul’s total liability under this Agreement is limited to the $150 deposit paid to ShiftHaul for that order, and ShiftHaul is not liable for indirect, incidental, or consequential damages.

9. Payment disputes

If you have a problem with a charge, please contact us first at [email protected] or (260) 800-6747 so we can resolve it quickly. You acknowledge that you reviewed and electronically signed this Agreement, including the payment and cancellation terms, and that ShiftHaul may provide this signed Agreement and its signing record to your card issuer in response to any dispute.

10. Indemnification

You agree to cover ShiftHaul’s losses and reasonable attorney’s fees caused by inaccurate information you provided, prohibited items left in the vehicle, or your breach of this Agreement.

11. Governing law

This Agreement is governed by the laws of the State of Indiana and applicable federal law, including Title 49 of the United States Code. Before filing any claim, you agree to notify ShiftHaul in writing and allow 30 days to resolve it informally. Any lawsuit arising out of or relating to this Agreement must be filed exclusively in the state courts located in Allen County, Indiana, or in the United States District Court for the Northern District of Indiana, Fort Wayne Division, or in small claims court in Allen County, Indiana, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, any claim must be filed within one (1) year after it arises or it is permanently barred.

12. Communications and electronic signature

12.1 You agree that ShiftHaul, its dispatchers, and the assigned Carrier may contact you by phone, text message, and email about this order.

12.2 You agree to receive this Agreement and related notices electronically and to sign it electronically. Your electronic signature has the same legal effect as a handwritten signature. A signed PDF copy will be emailed to you. You may request a paper copy at no charge or withdraw consent to electronic records by emailing [email protected]. Withdrawal does not affect documents already signed. You need a device with internet access, a web browser, and a PDF viewer.

12.3 You authorize ShiftHaul to share your name, phone number, addresses and order details with prospective and assigned Carriers to arrange your transport.

13. Other terms

This Agreement, together with your order confirmation, is the entire agreement between you and ShiftHaul. It may be changed only in writing confirmed by ShiftHaul (email is sufficient). If any provision is found unenforceable, the remaining provisions stay in effect.
